Government must respect the rights of natives

KOTA KINABALU, 9 Feb 2012: It is the non-fulfillment of the SFMLA that has jeopardized the natives living in the FMU area.
Refer to newspaper article by Tan Sri which appeared in the daily Express on 05/02/2012 entitled "Upholding recognition of native lands".
In 1997, the state government announced its new policy on sustainable forest management and the adoption of Forest Management Units as the working blocks for the management of its forest, a bold step for a workable definition of SFM and action strategy to achieving it. A strong and continue political commitment at the highest level is indispensable for sustainable forest management to succeed.

SABAH LAND REFORMS BY SAPP
1. NATIVE RIGHTS
Indigenous lands in perpetuity
Indigenous ancestral lands shall be vested in perpetuity collectively to the community and managed in accordance with native customs. Such land may not be sold or transferred or charged for any purpose that may lead to it losing ownership.
2. LAND FRAUD
Redress for fraudulent loss of NCRs
Lands in rural areas which have been fraudulently issued land titles to private companies or individuals against proven NCRs shall be recovered by the State Government and be returned to the original NCR owners; with compensation to the legitimate CL registered owners as required under the Federal Constitution; investigations and criminal proceedings shall be instituted against persons involved in the fraudulent processing, approval and issuance of land titles.
3. SCHEMES FOR SMALL FARMERS
Small holders scheme for all. Land schemes for small holders in various parts of Sabah shall be opened for settlement, cultivation and development by genuine local Malaysians in Sabah/Labuan, whether born or permanently resident in Sabah/Labuan
4. LAND FOR THE NATIVE PEOPLE
Land for Sabahans. No more land approvals to non-local companies for agricultural lands. Agricultural lands may only be approved and alienated to local Malaysians.
5. DEVELOPMENT OF LAND FOR COMMERCIAL, INDUSTRIAL AND HOUSING
Land as an economic resource
Approvals and all dealings on commercial, industrial and residential lands are encouraged so as to promote the people’s economic advancement. Urban commercial land shall be auctioned in accordance with proper procedures in order to maximise revenues to the State Government.
LAND TITLE/LEASE RENEWAL
Security of land tenure.
Applications to renew land leases in urban and rural areas will be approved as soon as possible without reducing the original lease tenure. Applications to extend the existing land lease tenure from 99 years to 999 years shall be allowed.
7. FOREST LAND
Forest community villages.
Traditional villages within forest reserves shall be enhanced as traditional villages (community forests) and managed under native customs; and all Forest Management Plans (FMPs) shall take into the account these villages and their future expansion and progress.
8. BURIAL AREA
Burial lands
Land gazetted as burial reserve land and native village cemetery must be maintained according to traditions and customs
9. GRAZING RESERVES
Grazing Reserves
Gazetted land as grazing reserves land bank shall be maintained so that local people can continue working in accordance with the original objectives
10. COMMUNITY TITLE
Communal Titles
Agricultural lands and settlements, especially communal titles, will be reviewed with a view to issue Native Titles (NTs) to local natives in the area concerned.
11. GOVERNMENT LAND
Lands that have been and are being used by government agencies will be reviewed to ensure that their intended uses truly benefit the people of Sabah.
URBAN LAND
Villages within urban areas
Existing villages in the urban areas with TL and CL land leases will be maintained as villages. Village development will be updated to suit current conditions.
13. FELDA LANDS
FELDA lands in Lahad Datu and Tawau shall be returned to its original purpose, which is for settlers, including second and third generation settlers.
14. LAND ADMINISTRATION IMPROVEMENTS AND UPDATING
Existing land administration will be studied in detail. Actions will be taken to ensure that land applications and issuance of land titles shall be expedited.

SAPP: Say No to Creative History

SIPITANG 11-09-2011: Leaders of Sabah Progressive Party (SAPP) celebrated the state level Hari Raya open house this year in Sipitang today (Sunday) held at Sabah Forest Industries-SFI Motel attended by about thousand people.
Tuan Haji Amdee Sidik the Chairman organizing committee who is also the State Southern Zone Chairman and the Deputy President of SAPP highlighted that there should be no compromise where history of the nation and specifically the history of Sabah is concerned.
History of Sabah especially in the formation of Malaysia has captured the headlines in recent weeks.
Tuan Haji Amdee is of the opinion historical records in our archives are the best source of understanding our past better.
"The director of the state - Datuk Tiga Belas archive is the appropriate authority to determine history without embellishing it. Creative history is often used to serve a greater purpose such as forging unity amongst the people of one nation.
"However, over-stretching creative history may deny others of their place in history and took their sensitivities for granted.
"This may lead discrimination and disenfranchisement of the identity, tradition, and culture and undermine the system of values in the segments of societies. As the result, instead of forging unity, it creates cleavages amongst the people.
Understanding history is never a futile exercise or a waste of time, according to Tuan Haji Amdee.
"Those who deny their history, deny their future and who are we to deny our children from their own future", he asked.

Appeal on Yong Vui Kong's case to International court of Justice (ICJ)

KUALA LUMPUR, June 16, 2011: Mr. M Ravi, Counsel for Yong Vui Kong (Singapore), YB Datuk Chua Soon Bui ( MP Tawau) Miss Ngeow Chow Ying' (Lawyer for Save Vui Kong campaign), Miss Sharmila Sekaran (Voice of the Children) handed over the memorandum to the Pegawai tugas-tugas Khas of the Minister of foreign affair, Mr. Ahmad Nordin.
YB Datuk Sri Anifah Hj Aman , Minister of Foreign Affair was not in the parliament during the visit of Mr. M Ravi who had earlier gave a press conference at the Parliament regarding the appeal to the Foreign Ministry to bring the matter to the the ICJ.
After the clemency appeal from the people of Malaysia, including people of Sabah, also the NGO and individuals from Singapore, Mr. M Ravi, the Singapore counsel for Vui Kong Made an application on 4th April 2011 for the Chief Justice, Mr. Chan Sek Keong, to disqualify himself from hearing the appeal, premised on the grounds that:-
a) requests the court to decide on whether the President of Singapore must act on the advise of the cabinet on the matters relating to the President's prerogative power on clemency ;
b) the Chief Justice who was the AG from 1992-2006, was in the position to advise and ought to have advised the President or the cabinet relating to the President's prerogative power on clemency during such period ;
c) thus there is a conflict of interest when the Chief Justice is to now decide on the matter which he had or ought to have advised the President and or cabinet about the clemency powers of the President.

POVERTY IN SABAH, AN ILLUSION?

THE fact that Sabah is still one of the poorest state in Malaysia cannot be denied by the Sabah State Government. No matter how the State Government refuted this status, it remains a fact that Sabah still has the most poor people in Malaysia, and not just poor, but hard core poor.
The revelation of the destitute family of widow Rosnia @ Annie Marambal brings to light the tip of the iceberg of the poverty situation in the State. And more disturbing is the acknowledgement by the Kota Marudu Member of Parliament YB Datuk Dr Maximus Ongkili that there are over 2,000 hardcore poor households in Kota Marudu according to the e-Kasih statistics.
According to Maximus, who is also the Minister of Science, Technology and Innovation, the government is trying to resolve the problem under the National Key Results Area (NKRA) and he hopes to take Kota Marudu out of poverty within the next five years.
We hope the Government can be more concerted in the poverty eradication program. So much money has been allocated and spent over the 8th and the 9th Malaysia Plan but we still get reports of abject poverty in the State.
There has been so many good reports and revelation by the media on poverty related cases in the past years: the many social visits by NGOs, and even a visit by the Crotian Ambassador to Kampung Morion in Kota Marudu.
The Kota Marudu MP should appreciate the contributions by the various sectors of society who show concerns in his constituency. Even Rosnia was quoted as saying that if not for the media help, she would not be getting all the attention when the relevant authorities entrusted with poverty eradication efforts failed. After the recent media reporting, Rosnia was registered under the e-Kasih programme.
"The plea of Rosnia and her family revealed that the delivery system is not reaching the people who most needed help! Which also means that the billions of dollars spent may not be reaching the target group. And Rosnia and few others reported in the media are just the few who get reported but there are still so many who are not reported but in equivalent destitute condition. What about our youths from the northern region who have to go and find work in KL and some even got stranded!," lamented Melanie.
The least the Kota Marudu MP could do is to appreciate the contributions by the civil society and all quarters in helping and heeding to the pleas of the needy. Perhaps he could also help to ensure that there is a greater degree of efficiency and accountability of the public spending.
